Legal question...

If I shoot a stranger with a water-pistol (without them having signed up to something like Street Wars), is that common assault? (or any other kind of crime)

I believe it counts as anti-social behaviour at the very least.

I'm not a laywer (and I don't play one on tv) but I'd guess that yes, it's assault.

Now, whether you they can get it to go as far as an arrest, would probably depend on whether you shot them with a small pistol or a super soaker. I would think, depending on who you shot, that you're more likely to get punched than have them call the police.

Are you in the habit of shooting strangers with water pistols?

Many summers ago, myself, Mark and a couple of our mates used to go out in his car, armed with water guns and shoot basically anyone we came across. Depending on who you shoot and how hot it is, you'd be surprised how many people will cheer.

To answer your question though, I think it probably is assault, but I doubt anyone would get very far in terms of actual prosection. I suggest waiting until you're fast enough to run away ;)

At a stretch, but I'd be surprised if it got far in court - probably a slap on the wrist.

However if you did it repeatedly, I think that would be classed as harrassment at the very least.

I've had my nose buried in Law textbooks etc since early this morning, and have just this minute stopped, so I don't think I will give this one any thought just at the moment.. ;)
