Cutting back to our main story of the day...

Dear Denny

The opponent's Solicitors have now come back with a gross offer of £115,000.00 in full and final settlement of your claim.

[...]

Roughly translated:
GAME OVER

YOU WIN

I've sent my instructions to accept the offer.

Nicely done. So, going back to the original story of the accident (having not seen the stuff inbetween), did the driver ever get charged over his negligence?

Nope. The Crown very rarely prosecutes when the case is unclear, particularly for fiddly little outcomes like a broken leg. As there were no witnesses on either side, they didn't feel the case was clear-cut enough to prosecute either of us.

Ah, I see...

(Reading your original story made me wince - I was hit by a car and fractured my fibula into about ten pieces about seven years ago, although that was partly my fault for not seeing the car)
